The University of Brighton Academies Trust, which is the governing body of the Hastings Academy, sets out its exclusion policy on its website as follows: “Where the academy’s approaches towards behaviour management have been exhausted, then suspensions and permanent exclusions will sometimes be necessary as a last resort… A decision to permanently exclude will only be taken in response to a serious breach or persistent breaches of the academy’s behaviour policy; and where allowing the pupil to remain at the academy would seriously harm the education or welfare of the pupil or others such as staff or pupils in the academy.

“All decisions to suspend or permanently exclude a pupil will be taken by the Principal after considering all the circumstances. Every decision made will be proportionate to the seriousness of the behaviour with reference to the academy’s behaviour policy.”

A gov.uk education website states that parents or carers should be invited to a review meeting with the school’s governors if their child has been permanently excluded. If the governors don’t overturn the exclusion, a challenge may then be made within 15 school days via the School Appeals Manager to an Independent Review Panel (IRP) convened by the East Sussex Appeals Service. Where an IRP either recommends reconsideration or quashes the initial decision, it will be considered within 10 further school days. This may involve a rehearing with oral evidence given by the academy and parents or may be a reconsideration with only the governors and a clerk present.
